Conveyancing Bowen Hills
Standard-fee conveyancing for Bowen Hills, three kilometres from our Brisbane office and one of the few suburbs in the city where the planning rules are not written by the council.
Bowen Hills is an inner north suburb that has been rebuilt around the Showgrounds, the Exhibition station and the Cross River Rail works. What changes hands here is mostly apartments and townhouses, with a thinner layer of worker cottages on the older streets near the Old Museum and Perry Park. Empire Legal handles the legal side from the moment the contract is signed through to settlement.
The unusual part is the planning. Much of Bowen Hills sits inside the Bowen Hills Priority Development Area, declared in 2008 and administered by Economic Development Queensland rather than Brisbane City Council. Land inside the PDA is assessed against the PDA development scheme, not the City Plan. If you are buying with a renovation or a development in mind, that distinction decides which rules apply to you and which authority you deal with.
What we handle for Bowen Hills buyers and sellers
- Apartment, unit and townhouse purchases
- Off the plan contracts in the new towers around the Showgrounds and Abbotsford Road
- Body corporate record searches and disclosure statement reviews
- Sales, including the seller disclosure statement
- Character cottage purchases on the older streets
- Investment purchases and settlements on tenanted units
Buying inside the Priority Development Area
The PDA covers around 108 hectares of Bowen Hills and provides for tens of thousands of new dwellings over its life. Two practical consequences follow for a buyer.
First, the searches are different. A standard council search will not tell you everything about a PDA property, and the development scheme has been amended several times since it commenced, most recently in 2025. We check which version applies and what it permits on the land you are buying.
Second, the neighbouring sites matter more than usual. A PDA is designed for density. The empty block beside a low rise building can be approved for something considerably taller, and that is not a defect in your contract, it is the point of the precinct. We would rather you knew before you signed than after.
Body corporate is where the risk sits
Most Bowen Hills sales are units, so the body corporate records are the single most useful thing we read. We look at the sinking fund and whether it is realistic for the building age, any special levy struck or under discussion, the by-laws on pets, parking, letting and renovations, and any defect history or live dispute. Newer towers can carry defect claims that are not obvious from an inspection.
The seller disclosure statement under the Property Law Act 2023 (Qld) has to be given before the contract is signed, and for a unit it must carry the body corporate certificate. If it is missing, a buyer may be able to terminate at any time before settlement. If it is given but inaccurate about a material matter, a right to terminate may arise where further conditions are met. Our note on body corporate certificates sets out what to look for.
Off the plan in Bowen Hills
There is a steady pipeline of new apartments here. We review the disclosure statement and proposed plan, check the sunset clause and the developer’s variation rights, and explain what can change between signing and settlement. Our page on off the plan contracts covers the mechanics.
Local knowledge
Bowen Hills sits between Breakfast Creek and the rail corridor, so flood and overland flow are worth checking street by street rather than assuming the whole suburb behaves the same way. Parts of the lower ground near the creek have a history; the ridge does not. Noise is the other local factor. The Showgrounds runs events, the Ekka takes over the precinct once a year, and the rail lines are close on several streets. None of that stops a purchase, but it should inform what you pay and whether you buy on a Saturday inspection alone.
Why Bowen Hills buyers and sellers choose Empire Legal
We are a Queensland property law firm with more than 16,000 settlements behind us and a 5.0 rating across our Google reviews. Every matter is run by a solicitor, not shuffled between call centres, and we pick up the phone. Queensland has no such thing as a licensed conveyancer, so the person handling your Bowen Hills contract is a lawyer.
We act for the buyer or the seller, never both in the same transaction.
Bowen Hills conveyancing costs at a glance
Our fixed professional fee is $2,600 including GST for a purchase and $1,600 including GST for a sale. Searches and government charges sit on top, and they vary with the property, so we quote them for the specific address rather than guessing. Full detail is on our pricing page.
Common questions about conveyancing in Bowen Hills
How much does conveyancing cost in Bowen Hills?
Our fixed professional fee is $2,600 including GST for a purchase and $1,600 including GST for a sale. Searches and government charges are additional and depend on the property. We quote the full figure for the specific address before you commit.
Is my Bowen Hills property inside the Priority Development Area?
Not every property is. The PDA covers a defined area of about 108 hectares, so the answer depends on the address. We check the boundary as part of the searches and tell you which planning regime applies and which authority assesses development on the land.
What should I check before buying an apartment in Bowen Hills?
The body corporate records, and specifically the sinking fund balance against the age of the building, any special levy, the by-laws on letting and pets, and any defect or dispute history. On a newer tower, also ask what remains under the builder’s statutory warranty period.
Does the Cross River Rail work affect properties here?
It affects amenity and access during construction more than title. Upgrades at Exhibition station are part of the project. What matters legally is whether any land has been resumed or affected, and that shows in the searches rather than in the marketing material.
Is Bowen Hills flood affected?
Parts of it are, particularly the lower ground toward Breakfast Creek. It is not a suburb-wide answer. We obtain the flood information for the individual property, and we would not rely on a standard contract to protect a buyer on a flood-affected property.
Do I need a solicitor to buy in Bowen Hills?
Queensland does not have licensed conveyancers, so property transfers here are handled by law firms. Given the PDA overlay and the body corporate exposure on units, Bowen Hills is not a suburb to attempt without advice.
How long does a Bowen Hills settlement take?
Thirty days is the common contract period in Brisbane, and most settle on time. Off the plan is different, because settlement follows registration of the plan rather than a fixed date, which is why the sunset clause matters.
Do you act for sellers as well as buyers?
Yes. Sale fee is $1,600 including GST. We prepare the seller disclosure statement, chase the body corporate certificate, and manage settlement. We never act for both sides of the same transaction.
