Conveyancing Ferny Grove
Standard-fee conveyancing for Ferny Grove, where the bush at the back of the suburb creates two issues that a city contract never has to deal with.
Ferny Grove sits at the end of the rail line about twelve kilometres north west of the Brisbane CBD, on Samford Road, with Ferny Hills and Keperra either side and D’Aguilar National Park and the Enoggera Reservoir catchment behind it. It has always been a detached housing suburb on generous blocks, a lot of it built out in the 1970s and 1980s, with plenty of slope and plenty of trees.
Two things have changed. The Ferny Grove Central development beside the station has brought apartments and a body corporate into a suburb that had almost none, and the bushfire and vegetation overlays have become a much bigger part of any sensible pre-purchase check than they were twenty years ago.
What we handle for Ferny Grove buyers and sellers
- House purchases and sales on the established streets
- Apartment and townhouse purchases in the station precinct
- Bushfire hazard and vegetation overlay checks
- Slope, retaining wall and access questions on the steeper blocks
- Seller disclosure statements under the Property Law Act 2023
- Body corporate record searches for the newer complexes
Bushfire hazard is a real search, not a formality
The western and northern edges of Ferny Grove back onto bushland, and properties in those areas can sit inside a bushfire hazard overlay. That has three practical consequences. It can impose construction standards on any new building or major renovation, it can affect what your insurer will offer and at what premium, and it can restrict how much of the vegetation around the house you are permitted to remove.
None of that appears in a standard Queensland contract, and none of it is covered by the seller disclosure statement. The only way to know is to obtain the planning information for the property during the contract period, which is what we do. If you are buying with a renovation in mind, this is the search that most often changes the plan.
Vegetation, and what you are allowed to cut down
Brisbane City Council protects significant vegetation, and a mature tree on a Ferny Grove block is not automatically yours to remove. Buyers who intend to clear for a pool, a shed or a second dwelling are sometimes surprised. Neighbouring trees raise a separate question again, because the Queensland tree and fence legislation gives a neighbour rights and obligations that the contract says nothing about. Our guide to neighbour disputes in Queensland covers trees, fences and retaining walls.
The station precinct and body corporate
The transit oriented development beside Ferny Grove station added apartments, retail and a large commuter car park on a site of roughly two and a half hectares. For a buyer, an apartment there is a body corporate purchase, which means the records are the important reading. Sinking fund against the age of the building, any special levy struck or under discussion, the by-laws on pets, parking and letting, and any defect history. On a recently completed building we also check what remains within the builder’s statutory warranty period. Our note on body corporate certificates sets out what a buyer should be looking for.
Local knowledge
Ferny Grove is Brisbane City Council, which surprises some buyers given how close Moreton Bay Regional Council is on the Samford side. The City Plan applies and the search timeframes are the Brisbane ones. Kedron Brook rises in this part of the city, so there are localised overland flow paths worth checking on the lower streets even though the suburb as a whole is not a flood suburb. On the steeper blocks, retaining walls and driveway access are worth looking at properly. A wall that is failing is not a dividing fence and the cost of fixing it does not simply get shared.

Common questions about conveyancing in Ferny Grove
How much does conveyancing cost in Ferny Grove?
Our fixed professional fee is $2,600 including GST for a purchase and $1,600 including GST for a sale. Searches and government charges are additional and depend on the property. We quote the total for the specific address before you commit.
Is my Ferny Grove property in a bushfire hazard area?
It depends on the address. Properties toward the bushland edges are more likely to be affected. We obtain the planning information during the contract period and tell you whether an overlay applies and what it means for building, insurance and vegetation removal.
Does the contract tell me about bushfire risk?
No. A standard Queensland contract contains no warranty about bushfire hazard, and the seller disclosure statement does not cover it either. It has to be checked through the searches before the contract becomes unconditional.
Can I remove trees on a Ferny Grove block after I buy?
Not always. Brisbane City Council protects significant vegetation, and overlays in the bushfire and biodiversity areas can restrict clearing further. If your plans depend on removing trees, that needs checking before you sign rather than after.
What should I check before buying an apartment near Ferny Grove station?
The body corporate records. Sinking fund, special levies, by-laws on letting and pets, and any defect or dispute history. On a newer building, also what remains under the builder’s statutory warranty period.
Which council covers Ferny Grove?
Brisbane City Council. Moreton Bay Regional Council starts a short distance up Samford Road, so the boundary is close, but Ferny Grove properties are assessed under the Brisbane City Plan.
How long does a Ferny Grove settlement take?
Thirty days from the contract date is the usual period, with finance and building and pest conditions falling due inside it. We track those dates and tell you early if any of them are at risk.
Do you act for Ferny Grove sellers?
Yes, at a fixed $1,600 including GST. We prepare the seller disclosure statement, obtain the searches it requires, and run the matter to settlement. We never act for both sides of the same transaction.
