Conveyancing Hemmant

Standard-fee conveyancing for Hemmant, a riverside suburb where the industrial history sitting next door to the houses is the thing that most often needs checking.

Hemmant lies about eleven kilometres north-east of the Brisbane CBD, on low-lying ground between the Brisbane River and Wynnum Road, with Tingalpa to the south, Murarrie to the west and Lindum and Wynnum West to the east. It is a genuinely mixed suburb. Detached housing on the streets around the railway station, and a working industrial and marine services belt along Lytton Road and down towards the river.

That mix is why a Hemmant contract deserves more than a glance. A house here can sit a few hundred metres from land that has been used for industry for decades, and the questions that raises are answered by searches, not by a drive past.

What we handle for Hemmant buyers and sellers

  • House purchases and sales, including older post-war housing stock
  • Contaminated land searches on the Environmental Management Register and Contaminated Land Register
  • Flood overlay questions on the low-lying river and creek flats
  • Industrial and mixed-use land contracts along the Lytton Road corridor
  • Seller disclosure statements under the Property Law Act 2023
  • Boundary, access and easement questions where residential meets industrial
  • Related party transfers and transfers between family members

Contaminated land is the Hemmant search that matters

Queensland keeps two public registers of land affected by contamination. The Environmental Management Register records land where a notifiable activity has been carried on or where contamination is suspected, and the Contaminated Land Register records land where contamination has been confirmed to a level that needs managing. In a suburb with Hemmant’s industrial history, those registers are not a formality.

A listing does not necessarily make a property unbuyable, but it changes what you are buying. It can restrict future use, it can require a site management plan, and it will matter again when you come to sell. Since the seller disclosure regime commenced, a seller has to disclose whether the land is recorded on either register, which is useful, but a buyer should still be checking the searches rather than relying on a tick in a box.

Low-lying land, flooding and excavation

Hemmant sits only a few metres above sea level on river flat country near the mouth of Bulimba Creek. Flood overlay mapping affects parts of the suburb and it should be checked against the individual lot rather than assumed from the street.

Two things follow from that. First, the standard Queensland contract does not give a buyer a right to get out because a property turns out to be flood affected, so the searches belong before you sign. Second, anyone planning to excavate, whether for a pool, a slab or a raise and build under, should ask early whether acid sulfate soil requirements apply to the site. Disturbing that kind of soil is a regulated activity in Queensland and the cost of managing it is not small.

Where a house backs onto industry

A part of Hemmant’s residential area sits close to industrial zoning. That can raise questions about access, heavy vehicle movements, easements running across a title, and what a neighbour is actually permitted to do with their land under the planning scheme. None of this is visible in the contract.

We read the title and the plan properly, so that easements, encumbrances and rights of way are identified and explained before you are committed rather than after.

Seller disclosure for Hemmant sellers

Since 1 August 2025, a seller of residential property in Queensland must give the buyer a signed disclosure statement with the prescribed certificates attached, before the buyer signs the contract. For a Hemmant property that will often include the contaminated land position as well as the title search and plan. If the statement is not given, or is given late, the buyer can terminate at any time up to settlement.

We prepare it and obtain the certificates as part of the fixed sale fee, so it is done properly and it is done before the property goes under contract.

What conveyancing costs in Hemmant

Our professional fee is fixed: $2,600 including GST for a purchase and $1,600 including GST for a sale. Searches and government charges sit on top and they vary with the property, so we quote them against the specific Hemmant address rather than guessing. Full detail is on our pricing page.

Common questions about conveyancing in Hemmant

How do I find out whether a Hemmant property is on the contaminated land register?

A search of the Environmental Management Register and the Contaminated Land Register answers it, and we run that search on Hemmant properties as a matter of course rather than treating it as an optional extra. If the land is listed we explain what the listing is for, what it restricts, and what it is likely to mean when you sell.

Does a contaminated land listing stop me buying a house in Hemmant?

Not automatically. Plenty of listed land is perfectly usable and the listing reflects a historical activity rather than a present hazard. What it does is change your obligations and your resale position, and it can limit what you are allowed to do with the site. The point is to know before you sign, and to price and negotiate with the information rather than without it.

How much does conveyancing cost in Hemmant?

Our fixed professional fee is $2,600 including GST for a purchase and $1,600 including GST for a sale. Searches and government charges are additional and vary with the property, and on a Hemmant property the search set is often slightly wider for the reasons above. We give you the total for the specific address before you commit.

Is Hemmant flood affected?

Parts of it are, because the suburb is low-lying river flat land close to the Brisbane River and Bulimba Creek. Whether a particular lot is affected is a question for the flood searches on that address, not for the suburb as a whole. Do that work before you sign, because the standard contract gives you no right to terminate once you learn the answer afterwards.

What should I check before buying a house near the Lytton Road industrial area?

The zoning of the neighbouring land, any easements or access rights recorded on the title, and the contaminated land registers. Planning permits what planning permits regardless of what is on the site today, so the useful question is what a neighbour could do, not only what they are doing.

Do you act for Hemmant sellers as well as buyers?

Yes, at a fixed $1,600 including GST. That covers preparing the seller disclosure statement and obtaining the prescribed certificates, and running the sale through to settlement.

Can you handle a commercial or industrial property in Hemmant?

Yes. Our fixed residential fees are quoted above and commercial work is quoted on the individual matter, because the scope varies a great deal. Send us the contract and the address and we will tell you what it will cost before we start.

Why does a Hemmant purchase need a law firm rather than a conveyancer?

Queensland does not licence conveyancers the way some other states do, so conveyancing here is legal work done by a law firm. That matters on a property like a Hemmant one, where a contaminated land listing or an easement question can turn into a legal problem that needs advice rather than a referral somewhere else.
