Conveyancing Tingalpa

Standard-fee conveyancing for Tingalpa, an eastern suburb where the two things worth checking are the creek and what the land next door is zoned for.

Tingalpa runs roughly between Wynnum Road and Old Cleveland Road, about eleven kilometres east of the Brisbane CBD, with Bulimba Creek along its western side and the Minnippi Parklands in the middle of it. The housing is a mix. Older post-war stock on the established streets, newer estates on the former farm and quarry land, and a working industrial belt along the Wynnum Road corridor toward Murarrie.

That mix is why two Tingalpa contracts on the same day can need completely different work. A creekside house and a new build on the eastern edge do not carry the same risks.

What we handle for Tingalpa buyers and sellers

  • House and townhouse purchases and sales
  • Flood searches and advice on Bulimba Creek exposure
  • New estate purchases, building covenants and community title schemes
  • Contaminated land register searches near the industrial corridor
  • Seller disclosure statements under the Property Law Act 2023
  • Investment purchases and settlements on tenanted properties

Bulimba Creek and flood

Bulimba Creek is the defining feature of western Tingalpa and it has a history. Properties near the creek and its overland flow paths can carry a materially different risk profile from streets a few hundred metres uphill, and the difference is not obvious from a Saturday inspection on a dry day.

A standard Queensland contract does not protect a buyer who finds out about flood exposure after signing. There is no general warranty from the seller that the land does not flood, and the seller disclosure statement does not fill that gap either. The protection comes from getting the flood information for the specific property before the contract becomes unconditional, and from what your insurer says once they see it. We obtain the flood searches and set out what they mean in plain terms.

Living beside industrial land

The Wynnum Road corridor through Tingalpa carries genuine industrial uses. Where a residential property adjoins or was formerly part of that belt, the environmental management register and contaminated land register searches stop being a formality. Land that has carried a notifiable activity, a service station, a workshop, fuel storage, can be recorded on the register, and that record follows the land, not the owner who caused it.

Finding it after settlement is expensive. Finding it during the contract period is a negotiation. We run those searches as a matter of course on properties near the corridor rather than only when someone asks.

New estates, covenants and community title

The newer parts of Tingalpa often come with building covenants that control what you can build, in what materials, and by when. Some lots sit inside a community title scheme with a body corporate even though the homes are freestanding. Both are enforceable and both survive the sale to you. We read the covenant and the scheme documents and tell you what you are agreeing to, particularly if you are buying land to build on rather than a finished house.

Local knowledge

Tingalpa is Brisbane City Council, not Redland, so the City Plan applies and the search timeframes are the Brisbane ones. That matters because the suburb borders Redland City on its eastern side and buyers regularly assume the wrong council. The Gateway Motorway and the Port of Brisbane freight route are close enough to be relevant to noise and access on some streets, and Minnippi Parklands has changed what the middle of the suburb looks like. As always, we work from the searches on your address rather than a suburb generalisation.

Why Tingalpa buyers and sellers choose Empire Legal

We are a Queensland property law firm with more than 16,000 settlements behind us and a 5.0 rating across our Google reviews. Every matter is run by a solicitor, not shuffled between call centres, and we pick up the phone. Queensland has no such thing as a licensed conveyancer, so the person handling your Tingalpa contract is a lawyer.

We act for the buyer or the seller, never both in the same transaction.

Tingalpa conveyancing costs at a glance

Our fixed professional fee is $2,600 including GST for a purchase and $1,600 including GST for a sale. Searches and government charges sit on top, and they vary with the property, so we quote them for the specific address rather than guessing. Full detail is on our pricing page.

Common questions about conveyancing in Tingalpa

How much does conveyancing cost in Tingalpa?

Our fixed professional fee is $2,600 including GST for a purchase and $1,600 including GST for a sale. Searches and government charges sit on top and depend on the property. We quote the whole figure for your address up front.

Is Tingalpa flood affected?

Parts of it are, particularly near Bulimba Creek and its overland flow paths. It is not a suburb-wide answer and the position changes over short distances. We obtain the flood information for the individual property during the contract period.

Does the standard contract protect me if a Tingalpa property floods?

No. A standard Queensland contract carries no general warranty that the land does not flood. The protection comes from checking before the contract goes unconditional, and from confirming that the property is insurable on terms you can live with.

Should I worry about contaminated land in Tingalpa?

It is worth checking where a property is near or was formerly part of the Wynnum Road industrial corridor. The environmental management and contaminated land registers record land that has carried notifiable activities, and that record attaches to the land rather than to a past owner.

What is a building covenant and can I ignore it?

It is a private restriction registered or contracted over lots in a newer estate, controlling matters such as materials, size and build timeframes. It is enforceable and it binds you as the new owner. We read it before you sign so there are no surprises about what you can build.

Is Tingalpa in Brisbane City Council or Redland City?

Brisbane City Council. The Redland boundary is close, which trips people up, but Tingalpa properties are assessed under the Brisbane City Plan.

How long does a Tingalpa settlement take?

Thirty days is the usual contract period, with finance and building and pest conditions falling due inside it. A vacant land purchase in a new estate can run longer if settlement is tied to registration of the plan.

Do you act for Tingalpa sellers?

Yes, at a fixed $1,600 including GST. We prepare the seller disclosure statement, gather the searches it requires, and manage the matter through to settlement. We do not act for both parties in the same transaction.
