Conveyancing in Maroochydore

Fixed-fee property law for Maroochydore, including off-the-plan contracts in the new city centre.

Maroochydore is in the middle of the largest greenfield CBD build in the country, and a growing share of what sells here is bought off a plan rather than walked through. That is a different legal transaction from buying an established home, with different disclosure, different timeframes and different ways to get hurt. Empire Legal reviews Maroochydore contracts, established and off-the-plan, on a fixed fee agreed up front, with a written report back to you inside 24 hours. More than 3,048 5-star reviews, and no surprises on the invoice.

Buying off the plan in the new Maroochydore City Centre

An off-the-plan contract asks you to commit today to something that will not exist for two or three years. The things that matter are the sunset date, what the developer is allowed to change without your consent, and what happens to your deposit if the project stalls. We check the sunset clause and who can trigger it, the tolerance the developer has given itself to vary the floor plan and finishes, whether the deposit sits in a trust account, and the disclosure statement against the plan you were actually shown in the display suite. If the building is delivered materially different from what was disclosed, your rights depend almost entirely on what the contract said when you signed it.

Established homes in Maroochydore, Alexandra Headland and Cotton Tree

Away from the CBD, Maroochydore is a settled market of post-war homes, walk-up units and canal-front blocks around the Maroochy River. Here the checks are different again: flood and storm-tide overlays on the low-lying river and canal frontages, the state of the pool safety certificate, whether any deck, carport or shed was built with approval, and whether the seller disclosure statement matches what the title and council records actually show. We read the flood overlay and tell you plainly what it means for insurance and resale rather than leaving you to interpret a colour on a map.

Investors, dual keys and short-stay near the beach and the airport

The Maroochydore rental market is pulled in two directions, by permanent tenants working in the new CBD and by holiday makers close to the beach and Sunshine Coast Airport. If you are buying to let, the questions worth answering before you sign are whether the scheme permits short-stay, whether there is an existing lease or letting appointment that binds you after settlement, and whether any depreciation or GST treatment attaches to a newly built lot. New residential property carries a GST withholding obligation on the buyer side that catches people out, and we deal with that as part of the settlement rather than as a surprise on the day.

Common questions about conveyancing in Maroochydore

Fixed fee, quoted before we start. Our fixed fee is $2,600 to buy and $1,600 to sell, with disbursements, searches and transfer duty on top. Off-the-plan matters can differ because there is more to review. Call 07 3088 7675 for your number.

It is the long-stop date by which the developer must register the plan and settle. If that date passes, one or both parties can usually walk away. Who gets to walk, and on what terms, is set by the contract wording, which is why it should be read before you sign.

On new residential premises the buyer generally has to withhold a portion of the price and remit it to the ATO at settlement. It is a mechanical step, but getting it wrong creates a real liability. We handle it as part of the settlement.

Yes. The whole matter runs electronically through PEXA and we work by phone and email, so you do not need to be in Queensland at any point.
