Conveyancing Morningside

Standard-fee conveyancing for Morningside, an inner-east suburb where an unusual amount of the housing has been subdivided, rebuilt or carved into townhouses, and where the title tells you far more than the listing does.

Morningside sits about five kilometres east of the Brisbane CBD along the Wynnum Road corridor, between Bulimba and Hawthorne to the north, Norman Park to the west and Cannon Hill to the east, with its own station on the Cleveland line. The older stock is post-war cottages and Queenslanders on generous blocks. A large part of what has been built since is small-lot houses, duplexes and townhouse developments squeezed onto those same blocks.

So the first question on a Morningside contract is usually structural: what exactly is the lot, and what comes attached to it?

What we handle for Morningside buyers and sellers

  • House, townhouse and unit purchases and sales
  • Community titles schemes, body corporate searches and levy questions
  • Small lot and subdivided lot contracts, including shared driveways and services
  • Easements, access rights and encumbrances registered on title
  • Pre-1947 character questions on the older streets
  • Seller disclosure statements under the Property Law Act 2023
  • Related party transfers and transfers between family members

Townhouses and duplexes: what you are really buying

A great deal of Morningside’s recent housing sits in a community titles scheme. When it does, you are not simply buying a house. You are buying a lot in a scheme, with levies, a sinking fund, by-laws and a community management statement, and with shared responsibility for whatever the scheme owns in common.

A body corporate search is where the real information is. We look for special levies already resolved or under discussion, whether the sinking fund is adequate for the age of the buildings, whether there is unrepaired defect work, and whether the by-laws restrict pets, parking, external changes or letting the property out short term. Those are the four that most often turn into an argument after settlement.

Small schemes deserve more attention rather than less. A two lot or four lot scheme has no professional manager, a thin sinking fund and a neighbour who is also effectively your co-owner of the roof.

Subdivided blocks, shared driveways and services

Where an old Morningside block has been split, the two new lots often share something: a driveway, a stormwater line, a sewer connection, a retaining wall. Those arrangements are supposed to be recorded as easements or as covenants on the titles, and sometimes the recording is less tidy than the physical reality.

We read the title and the survey plan, identify what is registered, and tell you what obligations come with it. A shared driveway easement is not a problem. A shared driveway with nothing registered over it is.

Character controls on the older streets

Parts of Morningside carry Brisbane City Council’s traditional building character overlay, which constrains demolition and shapes what a renovation of a pre-1947 house is allowed to look like from the street. If you are buying an old house with a plan to remove it or take the front off it, that is a pre-contract question, not a post-settlement one.

Seller disclosure for Morningside sellers

Since 1 August 2025, a seller of residential property in Queensland must give the buyer a disclosure statement with the prescribed certificates attached, before the buyer signs the contract. If the property is in a community titles scheme, the body corporate certificate forms part of it, and that takes time to obtain from the body corporate.

Fail to give it, or give it late, and the buyer can terminate at any time up to settlement. We prepare the statement and obtain the certificates inside the fixed sale fee, and we start on it early rather than when the contract is already signed.

What conveyancing costs in Morningside

Our professional fee is fixed: $2,600 including GST for a purchase and $1,600 including GST for a sale. Searches and government charges sit on top and they vary with the property, so we quote them against the specific Morningside address rather than guessing. Full detail is on our pricing page.

Common questions about conveyancing in Morningside

What should I check before buying a Morningside townhouse?

The body corporate records, ahead of anything else. Levies and what they cover, the sinking fund balance against the age of the buildings, any special levy already resolved or being discussed, any defect or remediation work on foot, and the by-laws. We read those records and tell you what they mean for your costs and your plans rather than forwarding you the minutes.

Is a small two lot body corporate in Morningside a problem?

Not in itself, but it is worth understanding. A very small scheme usually has no professional manager, a modest sinking fund and decisions that in practice need the agreement of one neighbour. When a roof or a shared wall needs work, the cost falls on two owners rather than thirty. We flag the size of the scheme and what it means before you sign.

How much does conveyancing cost in Morningside?

Our fixed professional fee is $2,600 including GST for a purchase and $1,600 including GST for a sale. Searches and government charges are additional and vary with the property. We give you the total for the specific address before you are committed.

Who is responsible for a shared driveway on a subdivided Morningside block?

It depends entirely on what is registered on the title. A properly drawn easement will say who may use it, who maintains it and who pays. Where nothing is registered, the arrangement is informal and depends on goodwill, which is exactly what fails when a property changes hands. We check this on every subdivided lot rather than assuming the physical arrangement is documented.

Does the character overlay apply to houses in Morningside?

It applies to parts of the suburb, on a lot by lot basis rather than across the whole of it. If your plan for the property involves demolition or a significant change to the street frontage, tell us before you sign so we can confirm the position while you can still act on the answer.

Do you act for Morningside sellers as well as buyers?

Yes, at a fixed $1,600 including GST. That includes preparing the seller disclosure statement and obtaining the prescribed certificates, which for a townhouse or unit means the body corporate certificate, and running the sale through to settlement.

How quickly can you review a Morningside contract before I sign?

Same business day. Inner-east Brisbane moves fast and properties here are often sold in a weekend, so send us the contract as soon as you have it rather than after you have committed.

Is a conveyancer or a solicitor better for a Morningside townhouse?

Queensland does not licence conveyancers the way some other states do, so conveyancing here is legal work done by a law firm. On a Morningside purchase that is worth having, because community titles documents, easements and character controls raise questions that need advice rather than a referral elsewhere.
